1. Agreement to these Terms
By accessing or using Credit GPS (the “Service”), you agree to these Terms of Service (the “Terms”) and to our Privacy Policy. If you do not agree, do not use the Service. These Terms are a binding agreement between you and Credit GPS Inc. (“Credit GPS,” “we,” “us,” or “our”), a corporation incorporated under the laws of Ontario, Canada.
2. What Credit GPS is — and is not
Credit GPS is a consumer credit-coaching and education service. We help you understand your credit and suggest specific actions (“moves”) you may choose to take.
We are not a lender, a bank, a credit reporting agency, a credit repair organization, or a financial, legal, or tax advisor. We do not lend money, hold deposits, or move funds. We do not repair, dispute, or alter your credit file, and we do not promise any particular credit score, approval, interest rate, or financial outcome.
3. Eligibility
To use the Service you must be at least the age of majority in your province or territory of residence, a resident of Canada, and able to enter into a binding contract. The Service is offered in Canada and is not directed to persons outside Canada.
4. Your account
You are responsible for the information you provide and for keeping your account credentials confidential. You are responsible for activity that occurs under your account. Please tell us promptly at support@creditgps.ca if you suspect any unauthorized use.
5. Connecting your financial accounts
You may choose to connect a financial account through our third-party provider, Plaid. This access is read-only: we read information such as balances, limits, statement dates, and reporting cycles in order to generate guidance.
We never move, transfer, or withdraw your money, and we do not store your online banking login credentials. You may disconnect a linked account at any time. Your use of Plaid is also governed by Plaid’s end-user privacy policy and terms.
6. Guidance is educational — no guarantees
Any forecast, score-lift range, confidence band, recommended payment, or “move” we provide is informational and illustrative only. Credit outcomes depend on factors outside our control, including the credit bureaus, your lenders, and your own actions. We do not guarantee any specific credit score, score increase, approval, interest rate, or savings. You are solely responsible for your financial decisions.
7. Not professional advice
Credit GPS provides general credit education and coaching. It is not financial, investment, legal, accounting, or tax advice, and it is not a substitute for advice from a licensed professional. Consider your own circumstances and seek professional advice where appropriate.
8. Fees and subscriptions
Some features are free during our pre-launch and for founding members, as described at sign-up. Paid subscriptions (for example, $9.99 CAD per month) renew automatically until cancelled, and prices may change on reasonable notice. Except where required by law, fees are non-refundable. You may cancel at any time; cancellation takes effect at the end of the current billing period.
9. Acceptable use
You agree not to misuse the Service. In particular, you will not:
- provide false, misleading, or fraudulent information;
- access or attempt to access accounts or data that are not yours;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service;
- reverse-engineer, scrape, or copy the Service except as permitted by law; or
- use the Service for any unlawful purpose or in violation of these Terms.
10. Intellectual property
The Service, including its content, software, design, and trademarks, is owned by Credit GPS Inc. or its licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.
11. Third-party services
The Service relies on third parties — for example, Plaid, the credit bureaus (Equifax and TransUnion), and our hosting and payment providers. We are not responsible for third-party services, and your use of them may be governed by their own terms and privacy policies.
12. Privacy
Our collection, use, and disclosure of your personal information is described in our Privacy Policy, which is incorporated into these Terms. We handle your information in accordance with applicable Canadian privacy law, including PIPEDA.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information or forecast is accurate, complete, or current.
14. Limitation of liability
To the fullest extent permitted by applicable law, Credit GPS and its directors, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or CAD $100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Credit GPS and its personnel from and against any claims, losses, liabilities, and reasonable expenses (including legal fees) arising from your misuse of the Service or your breach of these Terms.
16. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination (including sections 6, 7, 10, 13, 14, 15, and 18) will survive.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will give reasonable notice — for example, by posting the updated Terms with a new effective date or by email. Your continued use of the Service after the changes take effect means you accept the updated Terms.
18. Governing law and jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario, subject to any mandatory consumer-protection rights available to you in your province or territory of residence.
19. Language
These Terms are drafted in English. Where a translated version is provided, it is offered for convenience only; in the event of any conflict, the English version governs, except where applicable law (including Quebec’s language legislation) requires the French version to prevail.
